DPW Can Obtain Reimbursement for Medicaid Expenditures When Claim is Time-Barred The Pennsylvania Supreme Court in E.D.B. v. Gerald Clair and Centre Community Hospital, 2009 Pa. LEXIS 2790 (Pa. 2009) (Opinion by McCaffery, J.) reconciled opposite holdings reached by the Superior and Commonwealth Courts pertaining to the Pennsylvania Department of Public Welfare's (hereinafter "DPW") right to obtain reimbursement from a tortfeasor for Medicaid expenditures made on behalf of a disabled minor when a claim by the minor's parents is time-barred by the Statute of Limitations.
