O'Hara v. Liberty Mutual

Pennsylvania's Supreme Court on May 10, 2010 denied allocatur leaving intact the Superior Court decision upholding a forum selection clause in the Liberty Mutual policy governing underinsured motorist coverage. O'Hara, a resident of Delaware County at the time of her 2007 accident sought to recover UIM benefits from Liberty Mutual in an action in Philadelphia County. The Superior Court held that the Liberty clause did not violate the Pennsylvania Rulses of Civil Procedure governing venue.
