Pennsylvania’s Superior Court in Kline v. Travelers Personal Security Insurance Company in a November 18, 2019 decision addressed the issue of whether an auto insurer must offer an insured the opportunity to waive UI/UM stacking benefits when the insured adds additional vehicles to an auto policy. The court noted that an insurer must offer an insured the opportunity to execute a new waiver of stacked UI/UM coverage when the insured adds another vehicle to an existing policy, and that the addition of said vehicle to an existing policy constitutes a “purchase” under the MVFRL.
