Pennsylvania’s Supreme Court in a unanimous opinion today upheld an unlisted resident driver exclusion in a Safe Auto Insurance policy. The insured’s live-in girlfriend was operating the insured’s auto when involved in an accident. She sought liability coverage under the Safe Auto policy. The policy excluded liability coverage where the insured’s vehicle “is being operated by a resident of your household or by a regular user of your covered auto, unless the person is listed as an additional driver on the Declaration Page.” The insured had not added her as an additional driver under the policy. The Court sided with Safe Auto holding that the policy provision neither violated the MVFRL nor public policy. Attached FYI is the Court’s opinion.
