In light of this, the Pennsylvania Bar Association Committee of Legal Ethics and Professional Responsibility issued Formal Opinion 96-196, entitled Ethical Concerns of Insurance Defense Counsel with Comments Appropriate to Staff Trial Lawyers, co-authored by Chairman Thomas G. Wilkinson, Esquire. This Formal Opinion highlights common situations that may arise in the tripartite relationship and sets forth guidance based on the Pennsylvania Rules of Professional Conduct.
